BY ACCESSING AND USING THE FULHAM SITE YOU WILL BE LEGALLY BOUND BY THESE TERMS.

If you do not wish to be bound by these Terms and Conditions, You may not use the Fulham Site and should exit the Fulham Site at once.
These Terms and Conditions shall apply to Your use of the website located at www.fulhamfc.com and all pages and parts thereof ("the Fulham Site").

1. DEFINITIONS

1. "You/Your" means You, the user.

2. "We/Us" means [Fulham Football Club Limited] a wholly owned subsidiary of Fulham Football Leisure Ltd.

3. "Fulham Site" shall have the meaning as set out above.

4. "User Information" means the personal details which may be provided by You to Us via the Fulham Site.

5. "Users" means the users of the Fulham Site collectively and/or individually as the context admits.

6. "Website" means a site on the World Wide Web.

2. ACCEPTABLE USE

You agree that any use by You of the Fulham Site shall be in accordance with the following conditions:

1. You must not post or transmit through the Fulham Site any defamatory, threatening, obscene, harmful or pornographic material or material which would violate or infringe in any way upon the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience or which does not comply with all relevant laws. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. You must always treat other users with respect.

2. You will and must not post or otherwise make available on the Fulham Site any material which you do not own without the express permission of the owner of the material.

3. You may not copy, download, reproduce, republish, broadcast, print, transmit in any manner whatsoever, any material on the Fulham Site except as is strictly necessary for Your own personal non-commercial home use.

4. You agree not to use the Fulham Site to transmit any material for the purpose of publicity, promotion and/or advertising or any other commercial purpose.

3. THIRD PARTY WEBSITES

1. You acknowledge and agree that We are not responsible for the availability of any third party Websites or material You access through the Fulham Site, and do not endorse and are not responsible or liable for any content, advertising, products or services on or available from such Websites or material, nor for any damage, loss or offence caused, or alleged to be caused, by or in connection with use of or reliance on any content, advertising, products or services available on or available from such Websites or material.

2. Any dealings between You and any advertisers or merchants found on or via the Fulham Site, including payment for and delivery of products, services and any other terms, conditions, warranties or representations, associated with such dealings, are solely between You and the relevant advertiser or merchant. You agree not to hold Us liable for any loss or damage of any kind incurred as the result of any such dealings.

4. INTELLECTUAL PROPERTY

1. The Fulham Site is the property of [Fulham Football Club Ltd] a wholly owned subsidiary of Fulham Football Leisure Ltd. All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the Fulham Site shall remain at all times vested in Us or Our licensors. You are permitted to use this material or content only as expressly authorised in writing by Us or Our licensors and may not and agree not to assist or facilitate any third party to copy, reproduce, transmit, distribute, commercially exploit or create derivative works of such material or content.

2. If You become aware of any such unauthorised distribution or commercial exploitation, You agree to notify Us immediately.

3. You acknowledge that by posting materials on the Fulham Site You grant to Us and Our licensors and assigns an irrevocable, perpetual royalty free worldwide fully paid-up licence to use the materials within the Fulham Site and in any other manner. The licence extends to copying, distributing, broadcasting, and otherwise transmitting, re-formatting, adapting and editing the materials.

4. If you download any software from the Fulham Site, the software, including any images or files incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are subject to the limited licence set out at 2.3 above. We and/or Our suppliers (as the case may be) retain all right, title, interest and intellectual property rights in and to the Software. You may not distribute, sell, or transmit the Software and you are not permitted to alter, modify or adapt the Software in any way, including but not limited to translating, decompiling, reverse engineering, disassembling, or creating derivative works of it.

5. OUR RIGHTS

1. Material which is posted on any bulletin boards or chat forums is written by Users and We are not responsible for and give no endorsement of such material. We monitor the contributions and may respond to or comment upon communications by You and edit, refuse to post or remove any content from the bulletin boards and chat forums at our absolute discretion. No failure to remove particular material constitutes an endorsement or acceptance of it by Us.

2. To the extent permitted by law, We make no warranties, express or implied, as to the content of the Fulham Site or the accuracy, timing or reliability of any information or statements contained therein, or statements, advice and opinions given by Users on the bulletin boards and chat forums which are those of such Users only. We neither endorse nor shall be held responsible for the reliability or accuracy of the same and We are not responsible in any way for any injury, loss or damage which occurs as a result of an opinion expressed or information provided on the Fulham Site. If You have any claim arising from the actions or statements of another User, You agree to pursue such a claim only against that User and not against Us.

3. We will endeavour to provide the Fulham Site using all reasonable care. To the extent permitted by law, We exclude all implied warranties as to quality, accuracy or fitness for any particular purpose and We do not warrant that the material contained in the Fulham Site, any of the functions contained in the Fulham Site and the server will operate without interruption or delay or will be error free, free of defects, viruses or bugs or is compatible with any other software or material.

4. We reserve the right, at any time, to modify, alter, or update these terms and conditions of use, and You agree to be bound by any such modifications, alterations or updates which are posted on the Fulham Site.

5. We together with our agents, affiliates, directors, employees or other representatives shall not be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with Your use of the Fulham Site, whether direct or indirect, including, damage to software or hardware, loss of data, damage for loss of business, loss of profits, or any other consequential loss. Nothing in these terms or conditions shall exclude or limit Our liability for death or personal injury resulting from the negligence of Us, our servants, agents or employees.

6. PRIVACY

1. We shall comply with applicable UK Data Protection legislation from time to time in force in respect of any personal information relating to You gathered by Us.

2. You may be asked to input various basic information about yourself on different pages of the Fulham Site. At each location where information is requested there is a statement about the purpose for which that information will be used. We will not use the information given for any other purpose than that stated at each location.

3. Please email Us using the feedback section of the Fulham Site to notify Us of any changes to the information You have previously given or if You wish to withdraw Your consent to Our using the User Information for the stated purposes or for any form of promotional contact.

4. You acknowledge that, as is the case with all computer networks linked to the Internet, We cannot absolutely guarantee and will not be responsible for the security or privacy of information that you provide us with through the Fulham Site.

7. SAFETY

We give Our ongoing commitment to use all reasonable endeavours to ensure that ensuring that You can use the Fulham Site with confidence. When using the Fulham Site, in particular any bulletin boards or chat forums, You should always take the following precautions:

1. keep Your identity private. Do not give out Your full name, postal address, telephone number, e-mail address, the name of your school or any other information (other than that specifically requested by Us), that could help someone discover Your actual identity;

2. never get together with someone You meet online;

3. do not reply to any messages that are hostile, rude or inappropriate, or in any way make You feel uncomfortable. Instead, please let Us know about them immediately by emailing Us using the feedback section of the Fulham Site.

8. ON-LINE COMPETITION RULES

1. These rules set out in this Clause 5 (the "Competition Rules") apply to all competitions We run on Fulham Site ("Competitions").

2. By participating in any Competition You agree to be bound by the Competition Rules and by Our decisions, which are final in all matters relating to the Competition.

3. All prizes are non-transferable. Arrangements for the fulfillment of prizes will be made by Us. We reserve the right in Our sole discretion to substitute any and all prizes with prizes of comparable value.

4. In the event that You win a Competition, in order to be eligible for prizes, You will allow Us to use your name and likeness free of charge for advertising and publicity purposes.

5. The receipt, by You if You are a winner, of the prize for any Competition is conditional upon compliance with any and all laws, rules and regulations including without limitation the Competition Rules. Winners are solely responsible for all insurance, applicable taxes and for any expenses not specified in the prize description. Where prizes involve the winner(s) travelling, You as a winner (and guest if applicable) shall be required to hold a valid passport and/or other necessary travel documentation and visas.

6. We reserve the right to implement age requirements where necessary. Competitions are not open to Our employees or those of affiliated companies and subsidiaries, or to any and all of Our sponsors, suppliers and other connected parties and their immediate families.

7. By entering the Competition, You as an entrant assign to Us all rights, title and interest in all material uploaded onto the Fulham Site or otherwise provided by You.

8. Winners will be notified as soon as possible. For the names of the winners, please send an SAE to [Fulham Football Club, Craven Cottage, London SW6 6HH ] specifying the Competition.

9. Winners of Competitions agree that neither Us, nor Our subsidiaries, affiliates, related companies and employees, or any sponsors shall have any liability in connection with the acceptance or use of any of the prizes awarded herein. We reserve the right to disqualify any entrant and/or winner in Our absolute discretion.

9. INDEMNITY
You agree to indemnify Us, and/or any of Our affiliates and Our agents and their officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by You or any other liabilities arising out of Your use of the Fulham Site.

10. TERMINATION
We shall have the right to terminate immediately Your use of the Fulham Site if We determine in Our sole discretion that You have breached these terms and conditions or otherwise have been engaged in conduct which We determine in Our sole discretion to be unacceptable.

11. FEEDBACK
Should You wish to make any comments to Us about the Fulham Site or if you have any questions relating to the same please contact Us using the Feedback Form.

12. GENERAL

1. If any of these terms and conditions are determined to be invalid or otherwise unenforceable by reason of the application of any law, such provisions shall be severed and deleted from these terms and conditions and the remainder of these terms and conditions shall continue to have full force and effect.

2. The Fulham Site is controlled and operated in London, England. We do not make any representation that materials in and/or facilities or services offered through The Fulham Site are available for use in other locations, or that they comply with any legal or regulatory requirements of such other locations. You access this website at Your own risk and on Your own initiative and are responsible for compliance with local laws, to the extent that they are applicable.

3. These Terms and Conditions are governed by English law and both You and Us hereby submit to the non-exclusive jurisdiction of the English courts.

General Terms and Conditions Relating to the Sale of Tickets

1. Terms, Conditions and Regulations

1. Any person entering the Stadium (whether for a Home Match or otherwise as a visitor) must comply with these General Terms and Conditions relating to the sale of tickets to Club matches (the “General Terms and Conditions”), the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue, the applicable regulations of any Football Authority, and/or such other regulations as the Club may specify from time-to-time. Copies of any terms and conditions issued by the Club are available on the Club’s website at www.fulhamfc.com.

2. These General Terms and Conditions and the terms, conditions and the regulations set out in paragraph 1.1 and any other applicable regulations shall be subject to change from time-to-time. They will each be available on the Club’s website (as above) and/or (where applicable) on the website of the relevant Football Authority.

2. Contract Formation

1. When you submit your order, you are offering to buy tickets at the price stated in accordance with the terms and conditions, which, if accepted by the Club, will result in a binding contract. It is therefore important that you read and accept these General Terms and Conditions before submitting any order.

2. Once you have completed your order, you will be taken to have accepted the General Terms and Conditions and any terms and conditions applicable to your order and you will be asked to confirm that your order is correct. If it is not, you can amend or cancel the order before submitting it.It is your responsibility to ensure that your order is correct before submission. You should note that payment will be taken when you click the "make payment" button. This does not indicate our acceptance of your offer, and will be refunded in the event that we refuse your offer.

3. We will send a confirmation email upon receipt of your order. This is not an acceptance of your offer, but an acknowledgement that we have received your order and that it is held by the Club for processing. The contract between you and the Club will not be formed until we dispatch the tickets to the address as stated in your order.

4. Whilst we try to ensure that pricing and ticketing information on the Club’s official website is correct at all times, errors may occasionally occur. If we discover an error in the price or nature of the ticket you have ordered, we will inform you as soon as possible and will give you the option of reconfirming your order at the correct price/specification, or cancelling it. If we are unable to contact you, we reserve the right to treat the order as cancelled and you will be entitled to a full refund.

3. Entry to the Stadium

1. Any person entering the Stadium (whether for a Home Match or otherwise as a visitor) must comply with these General Terms and Conditions, the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue and/or such other regulations as the Club may specify from time-to-time.

2. The Stadium is private property owned and operated by the Club. Any person entering the Stadium shall do so with permission of the Club (which permission may be revoked at any time at the Club’s absolute discretion) and subject to your compliance with the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue and/or such other regulations as the Club may specify from time-to-time.

3. Without prejudice to any other remedies it may have, the Club shall have the right, at its absolute discretion, to refund any Home Match ticket, refuse entry to the Stadium to any person holding a Home Match ticket, or to suspend or eject any other person from the Stadium, on any occasion, including where (by way of non-limiting examples):
a. the Club considers in its absolute discretion that your entry in the Stadium may cause danger, discomfort or to you or any other person in the Stadium; or
b. the Club considers in its absolute discretion that you have breached (or that you will breach when entering or occupying the Stadium) any of the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue and/or such other regulations as may be applicable and/or as the Club may specify from time-to-time; or
c. you are the subject of any ban or suspension decision or order imposed by the Club and/or any other Football Authority or competent authority (including, without limitation, the Police).
Save that the Club does not seek to avoid or limit its liability in respect of death or personal injury caused to any person by the Club’s negligence, by entering into and occupying the Stadium you agree and acknowledge that the Club excludes to the maximum extent permitted by law, any liability for any loss, injury or damage to you and/or any other persons suffered or incurred by you at the Stadium. For the avoidance of doubt, the Club does not accept liability for any damage to, or any theft or loss of possessions suffered by any person at the Stadium.

4. Home Match tickets

1. Concession and Junior tickets holders must bring photographic identification (“ID”) to verify their eligibility for any Home Match ticket. The ID the Club will accept is limited to passports, photographic driving licences, freedom passes and EEC National Identity Cards. Under 14s must be accompanied by an adult, being a person who is 18 years or over.

2. The Club reserves the right, at its absolute discretion, to:
a. increase or decrease the price of Home Match tickets from time-to-time;
b. alter the categorisation of Home Matches from time-to-time; and/or
c. introduce Home Match ticket offers from time-to-time.
The Club will publish details of any such price changes, categorisation alterations and/or new offers on its official website at www.fulhamfc.com as soon as possible after the implementation of such change, alteration or offer. Any purchase of Home Match tickets after the change or offer shall be subject to the new prices, new designated category or terms of the relevant offer.

3. These General Terms and Conditions shall apply to any Home Matches played at the Stadium during the 2018/19 Season, including any play-off matches (where applicable).

5. Governing Law
Save where expressly stated otherwise, these General Terms and Conditions and any other terms and conditions or regulations applicable to tickets sold at the Stadium and/or entry of any person into the Stadium, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes between the Club and any person to whom these terms and conditions (or any other terms, conditions or regulations) apply, shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

6. Definitions
In these General Terms and Conditions, the following words and phrases shall have the following meanings:

“Football Authority” means each of the English Football League (EFL), the Premier League, The Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football;

"Ground Regulations" means those ground regulations issued by the Premier League from time to time which set out the terms and conditions upon which spectators are granted entry to the Stadium;

"Home Match" means any Football League or other match in which the Club participates and which takes place at the Stadium during the 2018/19 season;

“Season” means a season running from the first Match of the 2018/19 Premier League season until (and including) the last Match of such season, including any play off matches; and

“Stadium” means the Club’s Stadium at Craven Cottage, London SW6 6HH and all other locations owned, occupied or utilised by the Club.

Home Match Ticket Conditions of Issue

1. Issue of Home Match Ticket

1. The issue of a Home Match Ticket and subsequent access to the Stadium is subject to these Conditions, the General Terms and Conditions, the Ground Regulations, the Customer Charter and/or such other regulations as the Club may specify from time-to-time.Copies of any terms and conditions issued by the Club are available on the Club’s website at www.fulhamfc.com.

2. These Home Match Ticket Conditions of Issue, the terms, conditions and the regulations set out in paragraph 1.1 and any other applicable regulations shall be subject to change from time-to-time.They will each be available on the Club’s website (as above) and/or (where applicable) on the website of the relevant Football Authority.

3. By purchasing a Home Match Ticket you are required to agree and shall be deemed to have agreed to the Conditions at the point of purchase. For the avoidance of doubt, any person who purchases a Home Match Ticket on your behalf shall be deemed to be acting with the full authority of you and with authority to agree to the Conditions on your behalf.

4. Home Match Tickets are for the use of supporters of the Club only. By applying for a Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

2. Admission to the Stadium

1. A Home Match Ticket permits you to attend the Home Match at the seat indicated on the Home Match Ticket (or at such other alternative seat of equal price as the Club may allocate to you at its absolute discretion).

2. Nothing in these Conditions shall constitute or imply any entitlement on your behalf to occupy the seat indicated on the Home Match Ticket at any time other than during the Home Match, including in respect of any subsequent Home Match in any season.

3. Save as set out in clause 2.4 below, you shall not bring into (or use within) the Stadium any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Home Match or any aspect of it. Any person acting in breach of this provision will be required to deliver up any tapes, films, disks or other recordings or data to the Club and/or the Premier League and the copyright in any such recording or transmission is hereby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Club and the Premier League, as appropriate.

4. Mobile telephones are permitted within the Stadium, provided that they are used for personal and private use only.

5. Save for official Club merchandise and/or other football-related clothing worn in good faith, you shall not bring into, use, display, sell or offer for sale within the Stadium any sponsorship, promotional or marketing materials.

6. You shall not offer or distribute (either free or for sale by any person) within the Stadium any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

7. Without prejudice to any other remedies it may have, the Club shall have the right to refund any Home Match Ticket, refuse entry to the Stadium to any person holding a Home Match Ticket, or to suspend or eject any other person from the Stadium, on any occasion, including where (by way of non-limiting examples):
a. the Club considers in its absolute discretion that your entry in the Stadium may cause danger, discomfort orto you or any other person in the Stadium; or
b. the Club considers in its absolute discretion that you have breached (or that you will breach when entering or occupying the Stadium) any of these Conditions, the Ground Regulations, the Customer Charter and/or such other regulations as may be applicable and/or as the Club may specify from time-to-time; or
c. you are the subject of any ban or suspension decision or order imposed by the Club and/or any Football Authority or any other competent authority (including, without limitation, the Police).

3. Use of Home Match Ticket

1. The Home Match Ticket is issued for your sole use and you shall not resell, offer for sale, assign or (save as set out in clause 3.3 below) transfer the Home Match Ticket or the benefit of it to any other person without the prior written consent of the Club. Any reference to reselling the Home Match Ticket in these Conditions includes reference to offering to sell a Home Match Ticket, exposing a Home Match Ticket for sale, making a Home Match Ticket available for sale by another and advertising that a Home Match Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Home Match Ticket may not be offered as a prize in any promotion or competition or transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service or used for any other commercial purpose save as expressly authorised by the Football League and/or the Club.

2. The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the Police when it becomes aware that tickets are being sold illegally and/or without authorisation and will press for charges to be brought against those responsible. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed a ticketing offence, we will notify the Premier League, who may in turn notify other Premier League clubs and/or the UK Football Policing Unit. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticketing offences and disorder at Home Matches. 

3. In the event that you are unable to use your Home Match Ticket then you may transfer that Home Match Ticket to a natural person who is known to you personally who would be entitled to purchase such Home Match Ticket and attend such Home Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer must not be to a supporter of the away club at any Home Match and will in any event be subject to these Conditions (and any other applicable Club terms, conditions or regulations) which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the transferee as if he were the original purchaser of the Home Match Ticket (and you must inform the transferee of this). You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club or any police officer.

4. If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her personal use only PROVIDED THAT such transfer takes place to a person who is a Club supporter, such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party's business. Such transfer to any Guest will be subject to these Conditions which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3) apply to the Guest as if he/she were the original purchaser of the Home Match Ticket (and you must inform the Guest of this). You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club or any police officer.

5. Save where expressly set out otherwise herein, no person may purchase any more than 6 (six) Home Match Tickets for any Home Match.

6. The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your / your Guest’s identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

7. Any Home Match Ticket obtained or used in breach of these Conditions (and/or the Ground Regulations, the General Terms and Conditions or any other applicable terms and conditions) shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Misuse of this Home Match Ticket may result in the holder being refused entry to, suspended or ejected from, the Stadium in respect of a particular Home Match and/or the cancellation and/or withdrawal of the Home Match Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.7, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorised use of the Home Match Ticket.

4. Changes to Dates, Refunds & Exchanges

1. No guarantees can be given by the Club that a Home Match will take place at a particular time or on a particular date. The Club reserves the right to abandon, postpone and/or reschedule any Home Match without notice and save as set out in clause 4.2, such abandonment, postponement and/or rescheduling shall be without any liability to you (including without limitation in relation to any loss, damage, costs or expenses suffered or incurred by you).

2. In the event of the abandonment, postponement or cancellation of any Home Match, you will, subject to clause 4.3, be entitled to receive either a full refund or the equivalent ticket for the subsequent rescheduled Match via such application procedure as the Club stipulates. The Club will have no further liability to you whatsoever, including (but not limited to) any indirect or consequential loss or damage, costs or expenses or loss of enjoyment or travel costs suffered or incurred by you.

3. In order to obtain a refund, the Home Match Ticket must be returned to the Club's ticket office within 7 days of the abandonment or cancellation announcement (which shall be made on the Club’s website at www.fulhamfc.com, where possible). Tickets which include hospitality are subject to their own terms and conditions. It is the responsibility of the ticket holder to check the date and kick off time of Home Matches. A refund will only be issued where it is established upon production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the Club shall have the final decision as to whether to issue a refund and such decision shall be final and binding.

4. The Club reserves the right, at its absolute discretion, to increase or decrease the price of Home Match tickets and/or to alter the categorisation of Home Matches from time-to-time. The Club will publish details of any such price changes or categorisation changes on its official website at www.fulhamfc.com as soon as possible after the implementation of such change. Any purchase of Home Match tickets after the change shall be subject to the new prices and/or new designated category.

5. Lost or Stolen Home Match Tickets

1. In order to gain admission to the Stadium, the Home Match Ticket must be presented prior to, and remain on, your person for the entirety of the Match.

2. The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.

6. Cancellation & Withdrawal of Home Match Ticket

1. Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of these Conditions (and/or the Ground Regulations, the General Terms and Conditions or any other applicable terms and conditions issued by the Club) to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid. A non-exhaustive list of actions which shall constitute serious breach is as follows:
a. smoking in designated non-smoking areas;
b. being (or appearing to be) intoxicated by reason of any substance (whether alcohol, drugs or otherwise);
c. persistent standing in seated areas whilst the Match is in progress;
d. the sale or transfer (save as permitted) of a Home Match Ticket to any person;
e. the possession or display of a banner or flag that bears material or slogans that are offensive, obscene, abusive, racist or discriminatory;
f. the supply of any misleading or incorrect information in any application for a Home Match Ticket;
g. the use of foul, obscene, abusive, racist and/or discriminatory language and/or gestures;
h. the throwing of any object within the Stadium that may cause injury or damage to people or property without lawful authority or excuse;
i. the chanting of anything of an indecent or racist nature;
j. fighting or engaging in and/or inciting violence;
k. bringing into the Stadium (or using within the Stadium): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;
l. having possession of, consuming, or being under the influence of illegal drugs whilst in the Stadium;
m. entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
n. any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket;
o. any abuse of Club staff or other staff engaged at the Stadium, whether physical, verbal or in writing and whether in person, online or in any other forum and whether before, during or after any Match; and/or
p. any form of indecent exposure or streaking at a Match.

2. In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Home Match ticket or season ticket at its absolute discretion.

7. Exclusion of Liability
Save that the Club does not seek to avoid or limit its liability in respect of death or personal injury caused by its negligence, to the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Stadium. For the avoidance of doubt, the Club does not accept liability for any damage to, or any theft or loss of possessions suffered by any person at the Stadium.

8. Governing Law
These Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in respect of any dispute arising out of or in connection with these Conditions.

9. Definitions

In these Home Match Conditions of Issue the following words and phrases shall have the following meanings:

"Conditions" means these Home Match Ticket Conditions of Issue, which govern the issue and use of a Home Match Ticket;

“Football Authority” means each of the English Football League (EFL), the Premier League, The Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football; 

“Hat-trick Package” means a bundle of three consecutive Matches during the Season, subject to the terms set out at clause 3.8;

“General Terms and Conditions” means the General terms and conditions relating to the sale of tickets to Club matches;

"Ground Regulations" means those ground regulations issued by the Premier League from time to time that set out the terms and conditions upon which spectators are granted entry to the Stadium;

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under these Conditions;

"Home Match" means any Premier League match or other match in which the Club participates and that takes place at the Stadium during the 2018/19 Season;

"Home Match Ticket" means a printed paper ticket or other form of ticket (and/or any rights arising out of or in connection with the foregoing) for admission to a Home Match;

“Season” means the 2018-2019 Premier League season, including any play off matches; and 

"Stadium" means the Club’s Stadium at Craven Cottage, London SW6 6HH and all other locations owned, occupied or utilised by the Club.

Season Ticket - Conditions of Issue

1. Issue of Season Ticket

1. The issue of a Season Ticket and your subsequent entry into the Stadium is subject to these Season Ticket Conditions of Issue and each of the following (where applicable): the General Terms and Conditions, the Home Match Conditions of Issue, the Ground Regulations, the Customer Charter and/or such other regulations as the Club may issue from time-to-time.

2. These Season Ticket Conditions of Issue, the terms, conditions and the regulations set out in paragraph 1.1 and any other applicable regulations shall be subject to change from time-to-time. They will each be available on the Club’s website (as above) and/or (where applicable) on the website of the relevant Football Authority.

3. Season Tickets are for the use of supporters of the Club only.  By applying for a Season Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

2. Admission to the Stadium

1. Use of a Season Ticket constitutes acceptance of these Season Ticket Terms and Conditions.

2. A Season Ticket permits you to attend a Home Match at the seat indicated on the Season Ticket or such other alternative seat of equal price as the Club may, from time to time, allocate to you at its reasonable discretion.

3. The Club shall be entitled to move your seat to an alternative seat of equivalent price prior to or during a Home Match if it reasonably considers that your behaviour at such Home Match does (or may) adversely affect the enjoyment of other spectators at any Home Match or in any event where the Club believes (in its absolute discretion) that it is in the interests of your safety or other spectators’ safety at any Home Match to do so.

4. Nothing in these Season Ticket Conditions of Issue shall constitute or imply any entitlement by you to occupy the seat indicated on the Season Ticket at any match other than a Home Match or at any Home Match in any subsequent season.

5. Save as set out in clause 2.6 below, you shall not bring into (or use within) the Stadium any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Home Match or any aspect of it.Any person acting in breach of this provision will be required to deliver up any tapes, films, disks or other recordings or data to the Premier League and/or the Club and the copyright in any such recording or transmission is hereby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Club and the Premier League, as appropriate.

6. Mobile telephones are permitted within the Stadium, provided that they are used for personal and private use only.

7. Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Stadium any sponsorship, promotional or marketing materials.

8. You shall not offer or distribute (either free or for sale by any person) within the Stadium any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

9. Without prejudice to any other remedies it may have, the Club shall have the right to refuse entry to the Stadium, or to eject any person from the Stadium, on any occasion, including where (by way of non-limiting examples):
a. the Club considers in its absolute discretion that your entry in the Stadium may cause danger, discomfort orto you or any other person in the Stadium; or
b. the Club considers in its absolute discretion that you have breached (or that you will breach when entering or occupying the Stadium) any of these Season Ticket Conditions of Issue, the General Terms and Conditions, the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue and/or such other regulations as may be applicable and/or as the Club may specify from time-to-time; or
c. you are the subject of any ban or suspension decision or order imposed by the Club, any Football Authority, and/or any other competent body (including, without limitation, the Police).

3. Use of Season Ticket

1. Season Tickets are issued for your sole use and you shall not resell, assign or (save as set out in clause 3.2 below) transfer or lend the Season Ticket or the benefit of it to any other person without the prior written consent of the Club. The reference to reselling the Season Ticket includes reference to offering to sell a Season Ticket, exposing a Season Ticket for sale, making a Season Ticket available for sale by another and advertising that a Season Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Season Ticket may not be offered as a prize in any promotion or competition nor transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service, or used for any other commercial purpose, save as expressly authorised by the Premier League or the Club. 

2. You may only resell or transfer the Season Ticket to a Guest with the express written consent of the Club (which may be given at the Club's absolute discretion).No such resale or transfer will be permitted except where the same takes place in respect of an individual Match and in consideration of no payment or benefit in excess of the face value of a ticket to that Match and such transfer does not take place during the course of any business or for the purpose of facilitating any third party's business. Such resale or transfer to any Guest is subject to these Season Ticket Conditions of Issue, the General Terms and Conditions, the Ground Regulations, the Customer Charter, the Home Match Conditions of Issue and/or such other regulations as the Club and/or any Football Authority may specify from time to time. Any such rules and/or regulations will apply to that Guest as if he/she was the original purchaser of the Season Ticket (and you must inform the Guest of this).

3. The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that Season Tickets are being sold illegally and will press charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed a ticketing offence, we will notify the Premier League who may in turn notify other Premier League Clubs and/or the UK Football Policing Unit. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticketing offences and disorder at Home Matches. 

4. The Season Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Season Ticket at any time.

5. Any Season Ticket obtained or used in breach of these Season Ticket Conditions of Issue shall be automatically void and all rights conferred or evidenced by such Season Ticket shall be nullified. Misuse of this Season Ticket may result in the holder being refused entry to, or ejected from, the Stadium in respect of a particular Match and/or the cancellation and withdrawal of this Season Ticket. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable to the holder in respect of any unexpired portion of the Season Ticket. The Club further reserves its right to take any legal action against any person(s) as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Season Ticket.

6. Where a person intends to upgrade a junior Season Ticket or any concession Season Ticket for a Home Match, this shall only be permitted in respect of Home Matches taking place during weekdays and with an evening kick-off time.  Save where the Club expressly states otherwise in writing from time to time, upgrades shall not be available for any Home Match taking place on a weekend.  Upgrade prices (which may vary from time to time) will be released prior to the Home Matches to which they apply.

7. Where Season Tickets are purchased after the commencement of the Season (and within the dates set out in this clause), the cost of the Season Ticket will be reduced by the Club on a pro-rata basis, taking into account the full price of the remaining Home Matches in the Season as at the date of purchase. This offer will only be applicable to Season Tickets purchased between (and including) 1 September and 6 October 2018.

8. Season Tickets shall be valid for all Home Matches played by the Club at the Stadium during the Season. For the avoidance of doubt (and notwithstanding any provision or assertion to the contrary) Season Tickets shall not be valid for any play-off matches at the end of the Season, nor for any other cup matches, friendly matches or other matches outside the 2018/19 Premier League Championship season.

4. Changes to Dates, Refunds, Exchanges & Charges

 1. No guarantees can be given by the Club that a Home Match during the Season will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Home Match without notice and without any liability whatsoever. Your Season Ticket will enable you to attend the re-arranged Home Match.

2. The Club will have no further liability whatsoever to you or any other third party arising out of or in connection with the cancellation and/or rescheduling of any Home Match, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel costs.

5. Lost or Stolen Season Tickets

1. In order to gain admission to the Stadium, your Season Ticket must be presented prior to entering the Stadium and remain present during the entirety of every Home Match.

2. In the event that you forget your Season Ticket in respect of any individual Home Match, the Club shall not be obliged to admit you or issue any other form of ticket for that Home Match. If a duplicate Home Match ticket is issued to you, the Club may require prior payment of a non-refundable administration charge of £5.

3. If, in the Club's absolute discretion, a Season Ticket is damaged, lost, stolen or destroyed, a duplicate Season Ticket shall be issued by the Club as soon as reasonably practicable after the payment of a £5 non-refundable administration charge.  Only one duplicate Season Ticket will be issued to you per season and you will be required to sign a document confirming that the original Season Ticket is damaged, lost, stolen or destroyed and indemnifying the Club against any direct or indirect consequences of such matter having been falsely represented or stated to the Club.

4. Should any Season Ticket not arrive in the post after your purchase, you will be required to sign a document confirming this and undertaking to immediately return the original Season Ticket to the Club should it come into your possession at any time.  There will be no charge for the issue of a duplicate Season Ticket in this instance.

6. Change of Address

If you change your address during the Season you must notify the Club in writing as soon as possible.

7. Cancellation & Withdrawal of Season Ticket

1. Without prejudice to any other remedies it may have, the Club shall have the right in the case of any breach of these Season Ticket Conditions of Issue, the General Terms and Conditions, the Ground Regulations, The Customer Charter and/or any other conditions issued by the Club, to cancel and withdraw your Season Ticket. In the event of such cancellation no refund will be paid in respect of any unexpired portion of the Season Ticket. Without prejudice to the general nature of the above the following actions shall constitute a breach of these Season Ticket Conditions of Issue:
(a) smoking in designated non-smoking areas;
(b) being (or appearing to be) intoxicated by reason of any substance (whether alcohol, drugs or otherwise);
(c) persistent standing in seated areas whilst the Match is in progress;
(d) the sale or transfer (save as permitted) of a Home Match Ticket to any person;
(e) the possession or display of a banner or flag that bears material or slogans that are offensive, obscene, abusive, racist or discriminatory;
(f) the supply of any misleading or incorrect information in any application for a Home Match Ticket;

(n) any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket;
(o) any abuse of Club staff or other staff engaged at the Stadium, whether physical, verbal or in writing and whether in person, online or in any other forum and whether before, during or after any Match; and/or
(p) any form of indecent exposure or streaking at a Match.

2. In the event that your Season Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Home Match ticket or Season Ticket at its discretion.

8. Data

The Club will process any personal data you give to the Club in the course of purchasing a season ticket in accordance with its privacy policy, a copy of which can be found on the Club’s website at www.fulhamfc.com.  The Club will use this data for its internal business purposes and in order that you may benefit from special offers of Club products reserved for Season Ticket holders.  By way of example only, during the Season, the Club may ask Season Ticket holders to scan their Season Ticket cards when making purchases in the official Club shop in order that they can benefit from discounts on Club merchandise.   

9. Exclusion of Liability

Save that the Club does not seek to avoid or limit its liability in respect of death or personal injury caused by its negligence, to the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Stadium and the Club shall not be liable to you for any such loss or damage incurred or suffered by you.

These Season Ticket Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.

"Home Match" means any Premier League match or other match in which the Club participates and that takes place at the Stadium during the 2018/19 Season;
"Home Match Ticket" means a printed paper ticket or other form of ticket (and/or any rights arising out of or in connection with the foregoing) for admission to a Home Match, to which the Club’s Home Match Ticket Conditions of Issue apply;
“Season” means the 2018-2019 Premier League Championship season;
"Season Ticket" means a season ticket booklet (and all or any component vouchers therein) or any season ticket smartcard (and/or any rights arising out of or in connection with any of the foregoing) for admission to Home Matches; and
"Stadium" means the Club’s Stadium at Craven Cottage, London SW6 6HH and all other locations owned, occupied or utilised by the Club.

Membership Conditions of Issue

1. The issue of a Club membership card and your subsequent entry into the Stadium is subject to these Membership Conditions of Issue and each of the following (where applicable): the Home Match Conditions of Issue, the General Terms and Conditions, the Ground Regulations, the Customer Charter and/or such other regulations as the Club may specify from time-to-time.

2. These Membership Conditions of Issue, the terms, conditions and the regulations set out in paragraph 1 and any other applicable regulations shall be subject to change from time-to-time. They will each be available on the Club’s website (as above) and/or (where applicable) on the website of the relevant Football Authority.

3. Club membership cards are non-transferable. A Club membership card is only valid when used by the person to whom it is registered. Any breach of this provision will entitle the Club to demand the immediate surrender and cancellation of the membership card with no refund issued.

4. The membership card shall remain the property of the Club Membership cards may not be sold, exploited for commercial use, nor used for promotional purposes or campaigns.

5. All Club membership schemes are seasonal. The respective fee for each membership is therefore valid for one season only. Memberships purchased for use during the 2018/19 Premier League season shall expire on 31 May 2019.

6. The fee applicable to Club memberships apply for one season. The fee will not be reduced for new applicants wishing to join as members at any point once the season is underway.

7. The Club does not accept any responsibility for membership cards that are lost or destroyed. Lost membership cards should be reported immediately to the Club’s Ticket Office. Replacement membership cards will only be issued in exceptional circumstances and at a cost of £5.

8. All Club members who purchase Home Match tickets must at all times comply with the Home Match Conditions of Issue, the General Terms and Conditions, the Ground Regulations, the Customer Charter and/or such other regulations as the Club may specify from time-to-time.

9. All Adult membership applicants based in the UK must be on the electoral register and living at the address stated on the application. The Club reserves the right to refuse an application if the name of the applicant is not registered at their stated address. The Club further reserves the right to cancel, without refund, any memberships that are discovered to be registered to addresses that are not the primary residence of the membership card holder.

10. The Club reserves the right to make a decision as to whether, in the event of any cup-tie or play-off match during the 2018/19 season, Club members joining once the draw for the relevant match has taken place are eligible to obtain ticket priority for that tie.

11. Save where loyalty points are used as a means of determining eligibility to purchase tickets to certain Club matches, the purchase of a Club membership shall entitle you to:

a. primary priority above Season Ticket holders for the purchase of tickets for Club Home Matches in the Premier League during the 2018/19 Season; and
b. the same priority as Season Ticket holders for the purchase of tickets to Cup or Friendly matches during the 2018/19 Season.

12. Ticket priority for junior members extends only to applications for junior tickets. Junior memberships may be linked to adult memberships by ‘Friends & Family’ to consolidate a ticketing allowance.

13. Adult Club membership entitles that member to a £5 discount on the purchase of 1 ticket per match for select matches during the 2018/19 Premier League Season (excluding any play off matches).Concession membership (over 65 years of age or between 8 and 21) shall entitle the relevant member to a £3 discount on the purchase of 1 ticket per match for selected matches during the 2018/19 Premier League season (excluding any play off matches).To receive this discount, tickets must be purchased before 5pm the day prior to the relevant Home Match. Any discounts shall only be applicable to the individual member’s ticket and not to any other tickets purchased.

14. The number of tickets available to purchase by individual members through their respective priority window may vary on a match-by-match basis. It is the responsibility of the member to find out when tickets go on sale for each match, when the members' priority booking period commences and how many tickets they are able to purchase for that match. The Club will use its reasonable endeavours to ensure that every available club communication channel is utilised to provide ticketing information. 

15. A maximum of 4 membership cards may be used in one transaction (i.e. no more than 4 cards can be presented in one application).

16. Club membership does not guarantee a ticket to each match and the Club does not accept liability for any failure of a person to purchase a match ticket by virtue of his/her membership. It is recommended that you book your match ticket at your earliest convenience to maximise your chances of purchasing a ticket for a match.

17. All rights to priority regarding ticket sales for away games are at the absolute discretion of the Club and membership does not guarantee tickets for any specific game.

18. If the Club suspects for any reason that the Club membership card is being used fraudulently, in bad faith to obtain match tickets or otherwise in breach of any of the applicable terms and conditions issued by the Club from time to time, it retains the right to withdraw your membership and/or ban or suspend you from attending matches.

19. No refunds will be given in respect of membership fees, including where membership is withdrawn pursuant to these Membership Conditions of Issue.

20. If you are convicted of a ticketing offence, or we suspect you have committed a ticketing offence, we will notify the Football League and / or the Premier League and/or any other relevant authority, who in turn may notify the UK Football Policing Unit. The information that we share may include your details, information about the offence and about ticket purchases. We will use this to identify and prevent ticketing offence and disorder at matches. If you have any queries about this, please contact the Club’s Ticket Office.

21. Without prejudice to any other remedies it may have, the Club shall have the right to refuse entry to the Stadium, or to eject any person from the Stadium, on any occasion, including where (by way of non-limiting examples):

a. the Club considers in its absolute discretion that your entry in the Stadium may cause danger, discomfort or to you or any other person in the Stadium; or
b. the Club considers in its absolute discretion that you have breached (or that you will breach when entering or occupying the Stadium) any of the Ground Regulations, the Customer Charter, the General Terms and Conditions, the Home Match Conditions of Issue and/or such other regulations as may be applicable and/or as the Club may specify from time-to-time; or
c. you are the subject of any ban or suspension decision or order imposed by the Club, any Football Authority and/or any other competent authority (including, without limitation, the Police).

22. The Club will endeavour to process your Club Membership within 10 working days. Cards and Welcome Packs (if applicable) may take longer to arrive.

23. Any prizes won as part of your Club Membership (including any junior membership prizes) are non-transferable and cannot be used as a substitute for any other prize, offer, good or service.

24. In these Membership Conditions of Issue the following words and phrases shall have the following meanings:

“Football Authority” means each of the English Football League (EFL), the Premier League, The Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football;
 “General Terms and Conditions” means the General terms and conditions relating to the sale of tickets to Club matches;

"Stadium" means the Club’s Stadium at Craven Cottage, London SW6 6HH and all other locations owned, occupied or utilised by the Club.

 

Hospitality - Terms & Conditions of Sale

1. Definitions

In these Terms and Conditions (the "Conditions") the following words shall have the following meanings:

"Equipment" means any equipment provided by Fulham in the course of providing the Services;

"Match Date(s)" means the date(s) on which the Services are to be provided;

"Fee" means the amount to be paid by you in consideration for the Club’s agreement to provide the Services, as set out in the Invoice;

"Force Majeure" means any circumstances outside the reasonable control of Fulham including, without limitation, acts or threatened acts of terrorism, strikes, lockouts, industrial disputes or other restraints or stoppages of labour, acts of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order rule or direction, rules or instructions of any regulatory body (including (without limitation) The Football League, UEFA and/or The FA Premier League), inability to obtain supplies, inclement weather, accident, breakdown of Equipment, plant or machinery, fire, flood or storm;

"Fulham" means Fulham Football Club Limited, whose registered office is at Motspur Park, New Malden, Surrey KT3 6PT;
"Guest(s)" means the number of person(s) that you are authorised to invite to attend the Licensed Area on the Match Date in the course of the provision of the Services. In the event that Services are to be provided to you and your Guests, Fulham will issue tickets or passes only up to the aggregate limit of you and your Guests;

“Invoice” means (where applicable) the invoice sent by Fulham to you, in order that you may make payment of the Fee in accordance with clause 3;

"Licensed Area" means any lounge or hospitality area(s) in the Stadium licensed to you for use in the course of the Services on the Match Dates;

"Services" means the hospitality services to be provided by Fulham to you in accordance with these Conditions;

"Stadium" means the pitch, grounds, stadium and related facilities (including, without limitation, the Licensed Area) and any part thereof at Craven Cottage, Stevenage Road, Fulham, London SW6 6HH; and "you" / "your" means the person, firm, organisation or company making the booking.

2. Application of the Conditions

1. Save that you will also be required to comply with the Club’s General Terms and Conditions relating to the sale of tickets for Club matches, its Home Match Ticket Conditions of Issue, the Ground Regulations issued by the Premier League and the Customer Charter in relation to your entry into, and occupation of, the Stadium, these Conditions shall govern the provision of the Services to you by or on behalf of Fulham. No other terms or conditions, whether contained or referred to in any documentation, correspondence, purchase order or elsewhere sent by you or otherwise implied by trade, custom or course of dealing shall apply unless specifically agreed in writing by Fulham.

2. These Conditions shall become binding upon you at the point of purchase.  In the event of an online booking, these Conditions shall become binding when you complete the transaction and have confirmed your acceptance of the Conditions.  In the event that you receive an Invoice, you will receive a link to these Conditions and they shall become binding upon you paying the Invoice.

3. PAYMENT

1. Unless otherwise agreed in writing, you shall pay (without retention or set-off) the full Fee within 14 days of the date of the Invoice, together with any VAT due thereon. If the Match Date is within 14 days of the booking, you shall pay (without retention or set-off) the full Fee and any additional amounts required, together with any VAT due thereon, at the time of the booking.  No payment shall be deemed received until Fulham has received cleared funds.  Time for payment shall be of the essence.

2. Subject to clause 3.1, where you receive an Invoice, you are required to pay the Fee in full within 14 days prior to the Match Date.

3. Fulham reserves the right to resell the Services (or any part thereof) in the event of any default in payment, postponement or cancellation.

4. Where any sums are outstanding from you, Fulham reserves the right to refuse to supply the Services and/or to cancel or suspend all existing arrangements without liability to you and without prejudice to any of Fulham’s other rights, whether or not contained in these Conditions.  In addition, Fulham shall be entitled to claim interest at a rate of 7% per annum from the date for payment until satisfaction of the debt, as well as any charges and legal and other costs that Fulham incurs in pursuing or enforcing any debt recovery action.

4. CANCELLATIONS AND REARRANGEMENT OF SERVICES

1. Match Dates (including, without limitation, football match fixture dates) may be subject to change from time to time for reasons beyond Fulham's control (including, without limitation, television scheduling, cup competitions and postponement due to adverse weather conditions).  In the event that there is a change to the Match Date(s) or the nature of the Services, Fulham shall notify you of such change, postponement or cancellation as soon as reasonably practicable by telephone or email.  If you are unable to continue with the booking on any rescheduled date offered to you by Fulham (if such rescheduling is possible), you must advise Fulham immediately and in such circumstances, any Fee received from you in respect of the cancelled part of the Services will be refunded.

2. Subject to clause 4.1, any tickets purchased pursuant to these Conditions are non-refundable, save that:
a. where the ticket is returned between 14 and 21 days prior to the Match Date(s), Fulham shall be entitled to 50% of the Fee; and/or
b. where the ticket is returned more than 21 days prior to the Match Date(s), Fulham shall be entitled to 25% of the Fee.

3. For the avoidance of doubt, where any ticket is returned less than 14 days prior to the Match Date(s), Fulham shall be entitled to retain the full Fee and resell any ticket.

5. GUESTS

1. You shall be responsible and liable for the conduct of all Guests and shall ensure that all Guests conduct themselves in an orderly fashion, refrain from anti-social behaviour and abide by these Conditions and all applicable dress-codes and the Ground Regulations. Failure to do so may result in Fulham cancelling the Services at any time without liability and/or without refund to you.

6. OBLIGATIONS

1. You warrant, represent and undertake that you and any Guests shall:
a. comply with these Conditions, the General Terms and Conditions relating to the issue of tickets for Fulham matches, the Home Match Conditions of Issue and the Ground Regulations;
b. only use the Licensed Area for the purposes of the Services during the Match Date(s);
c. not use the Licensed Area for any purpose which Fulham may consider (in its sole discretion) illegal, immoral, dangerous and/or inappropriate;
d. not cause any nuisance or annoyance to any other person whatsoever, nor cause any obstruction to the access or egress at the Stadium and/or the Licensed Area;
e. not damage the Licensed Area or the Stadium nor litter or leave waste, but keep it in a clean and tidy condition, at all times to Fulham's satisfaction;
f. not encroach onto the pitch at the Stadium, nor use any foul and abusive, racist, homophobic or discriminatory language or gestures towards or in the presence of any persons in the Stadium;
g. not throw or drop objects or liquids from any part of the Licensed Area onto any other area within the Stadium;
h. not bring into the Licensed Area and/or the Stadium any dangerous or illegal substances;
i. not install or tamper with any fixtures or fittings in the Licensed Area and/or the Stadium (as applicable);
j. ensure that the Equipment is at all times used in a responsible, appropriate and proper manner and in accordance with any instructions given to you by Fulham;
k. not alter or damage nor attempt to repair or otherwise tamper with the Equipment or allow any third party to do so without Fulham's prior written consent;
l. at all times comply with the instructions of Fulham and/or its officers, employees or agents in relation to the Services, the Stadium and/or the Licensed Area;
m. at all times comply with any dress-codes, ticketing conditions and ground regulations; and
n. not remove any Equipment nor any other fixture, fitting or other item of property belonging to Fulham and/or its sponsors or guests, from the Licensed Area and/or the Stadium.

7. EQUIPMENT

1. Unless otherwise agreed in writing by Fulham, you shall only be permitted to use Fulham's Equipment during the course of the Services where equipment of that nature is required.
2. Unless otherwise specified in writing by Fulham, the Fee shall include the cost of hiring and using the Equipment on the Match Date.
3. The Equipment is and shall remain at all times the property of Fulham or its relevant third party supplier and you shall have no right, title or interest to the Equipment.
4. It is your responsibility to ensure that the Equipment requested is suitable and adequate in all aspects for the purpose for which it is hired.

8. LIABILITY

1. Nothing in these Conditions shall limit either party's liability for death or personal injury caused by its negligence, or for fraudulent misrepresentation.
2. To the fullest extent permissible in law, neither Fulham nor any of its officers, employees or agents shall be liable or responsible for (whether in tort, contract or otherwise):
a. any loss, damage (including, without limitation, theft or damage to property) or injury to you and/or any Guest or to any property belonging to you or any Guest in or upon the Stadium, Training Ground and/or the Licensed Area, resulting from any cause whatsoever; and/or
b. any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; and/or
c. any loss or damage caused by cancellation, postponement or rearrangement of the Services in accordance with clause 4.1 by Fulham (save to make any refund in accordance therewith).
3. You shall indemnify and hold Fulham and its officers, employees and agents harmless in respect of:
a. any breach by you and/or your Guests of any of your warranties, undertakings and/or obligations under these Conditions; and/or
b. any damage caused by you and/or your Guest(s) to the Licensed Area, Stadium and/or the Equipment.

9. TERMINATION

In the event that there is any failure to pay the Fee or any part of the Fee and/or if you and/or your Guests are in material breach of any of the provisions of these Conditions (including in particular, clause 6), the Club may, in its absolute discretion:
1. deny access to the Licensee and/or any of his/her Guests to the Stadium until such time as such breach is cured, without refund; and/or
2. terminate the relationship between Fulham and you with immediate effect.
3. In the event that Fulham terminates this agreement pursuant to clause 9.1 Fulham shall be entitled to:
a. retain the full amount of the Fee (if paid in advance); or
b. recover any outstanding balance of the Fee in full as a debt;
and in either case the Club shall have no further obligation of any kind to you.
4. Termination shall not affect your obligation to pay any unpaid part of the Fee and such sums shall become immediately due and payable on termination or expiry.
5. No waiver of any default or breach by Fulham shall be construed to be a waiver or release of any other subsequent default or breach by you for the purposes of these Conditions and no failure or delay by Fulham in the exercise of any remedy provided for in these Conditions or as available in law or in equity shall be construed a forfeiture or waiver thereof or of any other right or remedy available to Fulham.

10. FORCE MAJEURE

Fulham shall not be deemed to be in breach of these Conditions or otherwise liable to you as a result of any delay or failure in the performance of its obligations under these Conditions if and to the extent that such a delay or failure is caused by Force Majeure. 

11. MISCELLANEOUS

1. No food or alcohol may be brought into the Stadium and/or Training Ground (as applicable).  Save in the case of corporate hospitality packages, if food or alcohol is required, arrangements should be made with Fulham and agreed in writing.  Alcohol may not be consumed on or in the vicinity of the pitch and otherwise may only be consumed in areas designated by Fulham.

2. Food orders must be placed at least 7 days prior to the Match Date(s), with full payment for the food to be made when placing the order.  Food orders can be cancelled or reduced up to 7 days before the Match Date(s), with a full refund.  Any amendments made after that time will not be refunded.

3. Smoking is not permitted at the Stadium.

4. If match tickets are issued, it is your responsibility to safeguard these.  Any tickets lost, destroyed or stolen will not be reissued nor will refunds be given by Fulham.  You shall and shall ensure that all Guests shall comply with these Conditions including all applicable ticketing conditions, dress-codes and ground regulations at all times.

5. Nothing in these Conditions shall be intended to or deemed to operate as a tenancy or lease in respect of the Licensed Area or otherwise and neither you nor your Guests shall be entitled to any estate, right, title or interest in any part of or all of the Stadium and/or Training Ground (as applicable).

6. Fulham reserves the right, in its sole discretion, to refuse admission to you, any Guests and/or any other individual(s) to the Stadium and/or Training Ground (as applicable) and/or to evict you, any Guests and/or any other individual(s) from such venues.

7. Fulham reserves the right to amend these Conditions at its discretion.

8. Any personal information, including (without limitation), your name, address (including postcode) and/or email address will be held by Fulham in accordance with Fulham's privacy policy, which is available on the Fulham's website at www.fulhamfc.com.

9. No waiver by Fulham of any breach of these Conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

10. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provisions in question shall not be affected thereby.

11. This Agreement is personal to you.  You shall not co-license, sub-license, sell, assign, pledge or otherwise transfer your rights under this Agreement, without the prior written consent of Fulham.

12. To the fullest extent permissible in law, neither these Conditions are intended to nor shall they create any rights, entitlements, claims or benefits enforceable by any third person (including, without limitation, Guests).  Accordingly, no person shall derive any benefit or have any right, entitlement or claim in relation to these Conditions or the Services by virtue of the Contracts (Rights of Third Parties) Act 1999.

13. These Conditions shall be governed and construed in accordance with the Laws of England and Wales. The English Courts shall have exclusive jurisdiction in the event of any dispute other than in relation to the enforcement of judgements, where such jurisdiction shall be non-exclusive.

Ground Regulations

Notice: Entry to the Ground is expressly subject to acceptance by the visitor of these Ground Regulations and the rules and regulations of FIFA, UEFA, The Football Association, the Premier League and the English Football League (EFL) in respect of the relevant competition. The Ground Regulations incorporate the Club's Customer Charter (if any).

Entry to the Ground shall constitute acceptance of the Ground Regulations.

"Ground" means this football stadium and all locations owned, occupied or utilised by the Club.

"Club" means this football club.

"Match" means any association football match (or any part or aspect of such a match) taking place at the Ground. "Material" means any audio, visual or audio-visual material or any information or data.

Football Authority” means each of the English Football League (EFL), the Premier League, The Football Association, the Football Association of Wales, FIFA, UEFA and any other relevant governing body of association football;

  1. Notwithstanding possession of any ticket the Club, any police officer or authorised steward may refuse entry to (or eject from) the Ground any person:
  1. that fails (or in the Club's reasonable opinion is likely to fail) to comply with these Ground Regulations or any reasonable instruction issued by a police officer or authorised steward; and/or
  2. whose presence within the Ground is, or could (in the Club's reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person.
  1. On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order 1994 (as amended).
  2. The Club excludes to the maximum extent permitted by law any liability for loss, injury or damage to persons/property in or around the Ground.
  3. No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date and the Club reserves the right to reschedule the Match without notice and without any liability whatsoever.
  4. In the event of the postponement or abandonment of the Match, refunds (if any) will be made in accordance with the Club's Customer Charter. The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.
  5. All persons seeking entrance to the Ground acknowledge the Club's right to search any person entering the Ground and to refuse entry to or eject from the Ground any person refusing to submit to such a search.
  6. The following articles must not be brought within the Ground - knives, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, bottles, glass vessels, cans, poles and any article that might be used as a weapon and/or compromise public safety. Any person in possession of such items will be refused entry to the Ground.
  7. Further, you may not bring into the Ground any sponsorship, promotional or marketing materials save in respect of official club merchandise and/or other football related clothing worn in good faith nor may you offer (either free or for sale by any person) any goods (including literature) of any nature without the express written approval of the Club’s management.
  8. The use of threatening behaviour, foul or abusive language is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.
  9. Racial, homophobic or discriminatory abuse, chanting or harassment is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban for one or more Matches.
  10. The following acts are offences under the Football (Offences) Act 1991 (as amended):
  1. The throwing of any object within the Ground without lawful authority or excuse.
  2. The chanting of anything of an indecent or racialist nature.
  3. The entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse. Conviction may result in a Banning Order being made.
  1. All persons entering the Ground may only occupy the seat allocated to them by their ticket and must not move from any one part of the Ground to another without the express permission or instruction of any steward, officer of the Club and/or any police officer.
  2. Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from the Ground.
  3. The obstruction of gangways, access ways, exits and entrances, stairways and like places is strictly forbidden. Nobody entering the Ground shall be permitted to climb any structures within the Ground.
  4. Premier League stadia are smoke-free and smoking is not permitted inside the Ground.
  5. Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT (i) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (ii) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.
  6. Under the Sporting Events (Control of Alcohol etc) Act 1985 (as amended), the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made:
  1. Attempting to enter the Ground or being inside the Ground whilst drunk;
  2. Being in possession of any intoxicating liquor, or bottle, can or other portable container and which could cause damage or personal injury, when entering the Ground or in a public area of the Ground from which the event can be directly viewed.
  1. Any individual who has entered any part of the Ground designated for the use of any group of supporters to which he does not belong may be ejected from the Ground either for the purposes of his own safety or for any other reason.
  2. Save as set out in paragraph 16 above, no person (other than a person who holds an appropriate licence) may capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may they bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Copyright, database rights and any other intellectual property rights in any unauthorised recording or transmission is assigned (by way of present assignment of future rights) to the Club and the Premier League. You further agree (if and whenever required to do so by the Club and/or the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Club and the Premier League absolutely and with full title guarantee.
  3. No goods (including literature) of any nature may be offered either free or for sale by any person within the Ground without the express written permission of the Club.
  4. Tickets are not transferable and may not be offered for sale without the prior written permission of the Club - or otherwise in accordance with the relevant ticket terms and conditions. Any tickets that are transferred are transferred subject to these Ground Regulations. Any tickets offered for sale may be confiscated by any steward, officer of the Club or any police officer. The Club reserves the right to refuse admission to or eject from the Ground and/or “blacklist”, any person who has offered for sale or transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions). Tickets remain the property of the Club at all times.
  5. CCTV cameras are in use around and in the Ground. Body worn video cameras recording video and/or audio may also be used as appropriate, for example to record prohibited behaviours as referenced in paragraphs 9 and 10. The Club may itself use or pass to the police or any Football Authority or other clubs, any recordings for use in any proceedings.
  6. At all times whilst present in the Ground, persons must comply with any and all instructions of any steward or officer of the Club and/or any police officer. Failure to comply with any instruction may lead to immediate ejection from the Ground.
  7. By entering the Ground, all persons are acknowledging that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Premier League or others (including commercial partners and accredited media organisations) and entry into the Ground constitutes consent to such use.
  8. All ticket holders agree that the Matches for which the tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.
  9. Further to paragraph 24, if such person is under 18 years of age, the parent, guardian, or responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf. 27 Refused entry to (or ejection from) the Ground may lead to further action by the Club including, but not limited to, the withdrawal of any season ticket (without reimbursement), Club Membership and other benefits.
